LOS ANGELES (AP) — A man charged with stalkingJennifer Anistonand crashing his car through the front gate of her home has been found mentally incompetent to stand trial, but he demanded a second opinion at a court hearing Thursday. Jimmy Wayne Carwylea 48-year-old from Mississippi, appeared while in custody behind glass at a Hollywood courthouse that specializes in mental health cases. He had a long, gray beard and wore a thick, blue smock that jails use for suicide prevention. A county-appointed psychiatrist who evaluated Carwyle found the defendant incompetent, Deputy Public Defender Robert Krauss told the judge as he stood near his client with glass separating them. But Krauss said Carwyle, as is his right, would like an evaluation from a different psychiatrist. Los Angeles Superior Court Judge Maria Cavaluzzi ordered the reevaluation and set another hearing for May 29. Krauss declined comment outside court, as did the prosecutor handling the case and an attorney observing the hearing on behalf of Aniston. Prosecutors allege Carwyle had been harassing the "Friends" star with a flood of voicemail, email and social media messages for two years before driving his Chrysler PT Cruiser through the gate of her home in the wealthy Bel Air neighborhood of Los Angeles on May 5, causing major damage. He pleaded not guilty to felony stalking and vandalism at his first court appearance, where a judge paused the criminal proceedings so he could undergo the psychological evaluation. Carwyle remains jailed, but he is under a judge's order not to contact or get nearAniston. Authorities saidAniston was homeat the time of the gate crash, but he did not come into contact with her. A security guard stopped him in her driveway until police arrived. No one was injured. Carwyle also faces an aggravating circumstance of the threat of great bodily harm. If convicted, he could get up to three years in prison. If Carwyle is found incompetent again, the judge could order him to be sent to a state mental hospital for treatment and ongoing evaluation. Other than asking for the protective order for Aniston, prosecutors have not given their position on Carwyle's competency status, and did not speak at Thursday's hearing. Aniston became one of the biggest stars in television in her 10 years on NBC's "Friends." Shewon an Emmy Awardfor best lead actress in a comedy for the role, and she has been nominated for nine more. She currently stars in "The Morning Show" on Apple TV+.

According to court documents obtained by PEOPLE, filings dated Wednesday, May 21, revealed that the band comprised of Michael Diamond, Adam Horovitz andthe late Adam Yauch(who was represented by the executor of his estate) and UMG reached a settlement with Chili's parent company, Brinker International earlier this month outside of court. Brinker International has until July 7 to file a dismissal. The exact details of the settlement, which was "reached an agreement in principle to settle the case," have yet to be revealed. PEOPLE reached out to the Beastie Boys and Brinker International for comment and did not receive an immediate response. The Beastie Boys and UMGinitially sued Brinker International in July 2024on claims of copyright infringement. Per court documents obtained by PEOPLE, the band alleged that the use of the 1994 was unauthorized, along with the company reproducing an advertisement that was very similar to the 2002 music video directed by Spike Jonze. The Chili's commercial, which first debuted in November 2022, showed "three characters wearing obvious '70s-style wigs, fake mustaches, and sunglasses who were intended to evoke the three members of Beastie Boys," the suit alleged, much like the music video starring the Beastie Boys. Using "Sabotage" for the ad and recreating the music video allegedly infringed on the band's ownership of the song, which is protected by the United States Copyright Office. "Use of the 'Sabotage' sound recording, music composition and video was all without permission," the suit reads. "The plaintiffs do not license 'Sabotage' or any of their other intellectual property for third-party product advertising purposes, and deceased Beastie Boys member Adam Yauch included a provision in his will prohibiting such uses." Yauch, who died in 2012 after being diagnosed with cancer, famously noted in his will that "in no event may my image or name or any music or any artistic property created by me be used for advertising purposes,"according to the Associated Press. The Beastie Boys sought no "less than $150,000 for the willful infringement" over the use of their song without their permission. They also called for a trial by jury if necessary. National health agencies are putting a new focus on chronic illness in American children, releasing a new report Thursday that lays out the scope and potential causes of such illnesses. A later report is expected to make new policy recommendations to address the problem. FDA Commissioner Dr. Martin Makary spoke with Scripps News Thursday about what expected changes and priorities could look like. "When it comes to the health of the population, American health care has been a 50-year failure," Makary said. "So we've got to start being proactive and not reactionary. And that means asking big questions we've never asked before." "We saw today an announcement of SNAP waivers so that sugary drinks and junk food is removed from SNAP tax dollar programs," Makary said. "Maybe we need to treat more diabetes with school lunch programs instead of just treating kids with Ozempic and maybe we need to treat more back pain with ice and physical therapy, then just surgery and opioids. We need a fresh new approach." "We've got to talk about the microbiome and food as medicine and that means we also have to talk about environmental exposures and cancers and toxins that cause cancer, not just the chemotherapy to treat it. That is all a part of this Make America Healthy Again and initiative that the White House has put out today." "Half of our nation's kids are sick. They've got diabetes, pre-diabetes, obesity, or a chronic condition. 40% of our nation's kids now have a chronic disease. And so the only thing that's dangerous just to keep going down the path that we're on," Makary said. "We are taking a whole new approach at health. And that is going to be implemented at all of our health agencies. That means the NIH is going to look more at root causes, not just on chemotherapy to treat late-stage cancers. The FDA is going to look at the food supply. People forget that the F in FDA stands for food. Means is not a practicing physician and does not have an active medical license. Without mentioning Means by name, Adams outlined his positionin a May 22 post on X. Adams acknowledged that no explicit federal law mandates the surgeon general be a licensed physician. But he pointed to the surgeon general's legal obligation toserve as vice admiral of the U.S. Public Health Service Commissioned Corps, a uniformed service of health professionals for the federal government. But to be commissioned as an officer in the PHSCC, a physicianmust hold a current valid medical medical licensein addition tocompleting one yearof a medical residency or another accredited postgraduate medical program. Adams said the PHSCC qualifications are "implicitly (and legally) essential" to serve as surgeon general. Since Trump nominated Means‒ a 37-year-old Stanford University-educated wellness influencer ‒ as surgeon general on May 7, she has drawn scrutiny for her lack of medical license.Means' Oregon medical licenseexpired in 2019 and was moved to inactive in January 2024. "The Surgeon General's position as a trusted public health authority and physician makes full training and licensure a critical expectation in addition to an implicit legal requirement," Adams wrote. "This is in no way a personal criticism of any candidate, but a clarification for the sake of the integrity of the PHSCC that I was blessed and honored to lead," he added. "Failure to maintain these requirements not only compromises the mission and credibility of the service, but opens the PHS and HHS to lawsuits from others denied a commission or promotion, or terminated due to failure to meet these legal standards." The White House did not immediately respond to a request for comment. Trump tapped Means after withdrawing his first pick for the role,Dr. Janette Nesheiwat, a Fox News medical contributor. Means, a close ally of Health and Human Services SecretaryRobert F. Kennedy Jr., is an advocate for metabolic health and preventing chronic disease,who has a large social media following. Trump has lauded Means for having "impeccable 'MAHA' credentials," referring to Kennedy's Make America Healthy Again movement. But Means has drawn the ire from some on the far-right including activist Laura Loomer, an influential voice for Trump, who hascriticized Means' lack of medical licenseand accused her of havinga "history being a Marxist tree hugger."
